These Terms of Service ("Terms") govern your use of the Xiang Classical Music iOS app, Android (Google Play global) app, Android (mainland-China) app, and the websites bwv988.com and xiang.bwv988.com (collectively, the "Service"), operated by Shanghai Yufang Information Technology Co., Ltd. (Unified Social Credit Code 91310110MA1G84ER80; "we", "us", "Xiang").
By downloading, installing, accessing, or using the Service, or by tapping "Agree", "Sign in", or "Register", you confirm that: (a) you have read, understood, and accept these Terms; (b) you are at least 14 years old, or have your parent/guardian's consent; (c) you accept our Privacy Policy for the processing of your personal information.
Changes: for material changes, we give at least 30 days' advance notice via in-app banner and (if you provided email) email. Continued use after the effective date constitutes acceptance.
2. The Service
Xiang aggregates and displays global classical-music concert information; provides metadata on composers, performers, and works; lets you filter, favorite, and add concerts to your calendar; and plays recommended tracks via your subscribed Apple Music or Spotify. Subscription tiers: Free, Member, Patron. The Service depends on third parties — Apple Music, Spotify, Apple Sign-In, WeChat, Apple App Store, Google Play, Alipay, WeChat Pay — whose own terms apply. 3. Account
You may register via Sign in with Apple (all editions) or WeChat (Android China only). You agree to provide accurate information and keep it current. You are responsible for safeguarding your account and devices. Suspected unauthorized access should be reported to support@bwv988.com. You may delete your account in Settings → Account → Delete Account, or by emailing privacy@bwv988.com; deletion consequences are described in Privacy Policy §9.
4. Subscriptions & Payment
iOS: auto-renewing subscriptions via Apple App Store
Android Google Play: auto-renewing subscriptions via Google Play
Android China: one-time prepaid Member periods via Alipay or WeChat Pay (no recurring billing, no auto-renew)
For auto-renewing subscriptions: charges are taken at confirmation; auto-renewal occurs within 24 hours before the period ends at the then-current price; you may cancel via Apple ID or Google account settings. Refunds follow Apple's or Google's refund policy. For Android China one-time purchases, payments are non-refundable, but if a material Service failure prevents you from using the entitlement, you may request equivalent compensation within 30 days at support@bwv988.com. Account deletion does not entitle you to a refund of paid subscriptions. We may adjust prices; changes apply to the next billing cycle with advance in-app notice.
5. Acceptable Use
You agree not to: violate applicable law; infringe others' IP, image, reputation, or privacy rights; post illegal, harmful, harassing, defamatory, obscene, violent, or otherwise inappropriate content; disrupt the Service or harm other users' experience; use automated tools, scrapers, or simulated taps to access or harvest the Service; reverse-engineer, decompile, or circumvent technical protection measures; impersonate any person or entity. We may, in our discretion, remove infringing content, suspend or terminate accounts, report to authorities, and pursue legal remedies.
6. Intellectual Property
The Service, its UI, source code, text, images, audio/video, trademarks, and logos are owned by us or our licensors. You retain rights in content you publish; you grant us a non-exclusive, royalty-free, sublicensable, worldwide license to store, copy, technically modify, and display such content to operate the Service. The license ends when you delete content or your account, except for copies already collected by other users. Third-party works displayed in the Service belong to their rightholders; we display them for informational purposes. IP-infringement notices may be sent to support@bwv988.com (subject: "Infringement Notice") including proof of identity, proof of ownership, location of infringing content, reasons, and contact details; we will act in accordance with applicable law (including DMCA where applicable).
7. Disclaimers
Accuracy: concert information, artist data, and work descriptions come from public sources; we do not guarantee accuracy, completeness, or timeliness. Verify critical details with official sources.
Availability: we strive for stability but do not guarantee uninterrupted or error-free Service. We are not liable for interruptions due to maintenance, force majeure, third-party failures, or your device/network issues.
Third-party links: the Service may link to third-party sites; we are not responsible for their content.
Limitation of liability: to the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages. Our total liability is capped at the amount you paid us in subscription fees during the 12 months preceding the claim.
Recording-recommendation disclaimer: recommended recordings are matched automatically by work title and composer; we do not guarantee match with the actual performance, conductor, ensemble, or recording version.
Concert info disclaimer: details may differ from reality; always verify with the venue, promoter, or artist before purchasing tickets or attending.
Subscription value: we work to expand coverage; we do not guarantee full coverage of any region or all events.
8. Privacy
Our Privacy Policy describes how we collect, use, store, share, and protect personal information; it forms an integral part of these Terms.
9. Children
The Service targets users aged 14 and older. Minors must obtain parental/guardian consent. See Children's Privacy Notice.
10. Disputes & Governing Law
These Terms are governed by the laws of the People's Republic of China (excluding conflict-of-laws rules). The parties shall first attempt to resolve any dispute through good-faith negotiation for 30 days. If unresolved, either party may bring suit in the People's Court of Yangpu District, Shanghai.
If you are a consumer resident in a jurisdiction (e.g. EU member states) whose mandatory consumer-protection rules grant you the right to sue in your home court, these Terms do not deprive you of that right.
11. Miscellaneous
Entire agreement with Privacy Policy, SDK List, Data Collection Inventory, Cross-Border Transfer Inventory, and Children's Privacy Notice. Severability: invalidity of any clause does not affect others. No waiver: failure or delay to enforce any right is not a waiver. Assignment: you may not assign without our written consent; we may assign to an affiliate or successor with notice.
